GENERAL CONSIDERATION
DANCAS AUTO AUCTION, (Overwheels Corp.) created this space to make it easier for sellers to sell their vehicle. This marketplace operates on mutual trust and respect between all parties, allowing sellers through its digital platform, to sell their vehicle in a safe and transparent way, providing the seller with the necessary tools for this operation.
RULES
A Seller will build confidence in its product and credibility with Buyers by disclosing all material facts about the history and condition of the vehicle offered for sale. A Seller consigning a vehicle for sale to a DANCAS AUTO AUCTION participant is required to disclose the information listed below. The list is neither enumerative nor qualitative. As vehicles and our industry change, the disclosure obligations required of sellers may similarly change. Accordingly, DANCAS AUTO AUCTION reserves the right to require disclosure of other information not specifically listed below.
A seller cannot claim ignorance of pre-existing faults or problems with the vehicle. The seller accepts that if the buyer finds any undeclared defect prior to the sale he will have three days to return it and the transaction will be declared void and the seller must return all monies received by DANCAS AUTO AUCTION plus any expenses incurred by DANCAS AUTO AUCTION in carrying out the sale.
Seller agrees that DANCAS AUTO AUCTION is "NOT" responsible for theft, fire, hail, flood, collision, bumps, scratches, glass breakage, upholstery damage that the vehicle left on consignment at the DANCAS AUTO AUCTION yard may suffer, and that the consigned vehicle has the appropriate insurance to cover such damage. Sellers are advised to remove personal property, cellular phones etc. from their vehicles prior to checking in the vehicle.
Once the auction is over, if the vehicle is not auctioned, the seller must remove it from the auction within 72 hours, after that time will be charged $20 per day of storage, after 30 days it will be sold for storage and abandonment.
Auction makes no representations or guarantees on any vehicle sold or offered for sale. b. Auction is not a party to the contract of the sale. The sales contract is between the Seller and Buyer only. c. All vehicles bought or sold on the premises must be processed through the Auction office. Failure to do so will result in suspension of trading privileges at Auction. d. Auction reserves the right to review any audio/video documentation to verify the accuracy of a sale. e. Any vehicle consigned with the Auction is subject to government inspection, with or without prior notice, by the FBI, State Police, National Auto Theft Bureau, Local Police Authorities, any other governmental agency, or quasigovernmental agency.
Seller and Purchaser agree to abide by all auction policies and policy decisions of management. The SELLER covenants with the PURCHASER that he is the true and lawful owner of the described vehicle; that the same is free from all liens and encumbrances: that he has good right and full power to sell and transfer title to the same; and that he will warrant and defend that same against the lawful claims and demands of all persons whomsoever. If seller is a corporation, by the execution of this agreement, the officers of said corporation do hereby individually and personally guarantee performance of the corporation’s warranties.
Seller and Purchaser agree to indemnify and hold DANCAS AUTO AUCTION Auction harmless from any liability, loss, costs, damage or expense, including attorney’s fee which may arise either directly from the sale and purchase of the vehicle including, but not limited to, any matters relating to odometer, mileage statement.
LIGHTS POLICY
- GREEN LIGHT (Run and Drive)
Seller declares that the vehicle is mechanically sound and subject to all arbitration policies;
Seller represents that there are no major defects in the internal parts of the engine, transmission, and rear end exceeding $500.00 to repair;
Major damage history / total loss must be announced;
- YELLOW LIGHT (CAUTION HAS ANNOUNCEMENT)
Vehicles sold under the yellow light condition are sold with caution or change to vehicle status. Buyer is responsible for listening to ALL announcements for a yellow light condition sale. There is NO arbitration under yellow light conditions.
The following conditions represent an “AS–IS” sale and are not subject to arbitration for any reason, except odometer discrepancies, frame/unit-body and mandatory announcements.
- All vehicles sold under $3,000.00
- All vehicles 10 years old and older
- Vehicles that have more than 125,000 miles.
- All miscellaneous vehicles such as boats, campers, taxi’s, motorcycles, dune buggies, trailers, jet skis, antique cars, snowmobiles. These items are exempt from arbitration for frame/unit-body damage, mileage/hours and year model. These vehicles are sold “AS-IS”.
- Sellers must use the light system and make the necessary announcements to properly identify the following:
Frame damage, excessively rusted or rotted frames. (sold “AS-IS”)
Flood, fire, salvage, reconstructed, antiques (1980 or older), clip cars, motorcycles, boats, and trailers must be announced and sold “AS-IS”
Gas/Diesel conversions.
TMU – True miles unknown, will be sold “AS-IS”.
“Lemon-Law” vehicles sold “AS-IS”.
Police cars and Taxi’s sold “AS-IS”.
All vehicles towed through the block must be sold “AS-IS”, and are not subject to arbitration for any reason.
PAYMENTS
Payment will be made to the seller by bank transfer to the account specified in the registration form, for the payment to be made the seller must have delivered to DANCAS AUTO AUCTION the title of the vehicle within three days after the sale has been made, otherwise DANCAS AUTO AUCTION may consider the sale void and proceed to charge the seller the costs of non-compliance with the transaction, storage of the unit if it is in the yard of DANCAS AUTO AUCTION.
DANCAS AUTO AUCTION undertakes not to deliver the vehicle sold until it is fully paid, the SELLER may choose to sell his vehicle in cash or financed mode, if he accepts that the vehicle is sold in the financed mode, he accepts the time that the Banks have to pay each sale, without this DANCAS AUTO AUCTION, will always keep the seller informed of the current status of the sale, unless the delay is due to lack of information or documentation that the buyer did not provide in a timely manner.
